Some Major Acts covering Persons with Disability

The National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities act, 1999
This is an act which provides for the constitution of a body at the national level for the welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities
The Act envisages the setting up of a National Trust whose main objects would include :

  • enable and empower persons with disability to live as independently and as fully as possible within and as close to the community to which they belong;
  • to strengthen facilities to provide support to persons with disability to live within their own families;
  • to extend support to registered organizations to provide need based services during the period of crises in the family of persons with disability (Any association of person with disability or any association of parents of persons with disability or a voluntary organization whose main object is promotion of welfare of persons with disability may make an application for registration to the Board)
  • to deal with problems of persons with disability who do not have family support;
  • to promote measures for the care and protraction of persons with disability in the event of death of their parent or guardian;
  • to evolve procedure for the appointment of guardians and trustees for persons with disability requiring such protection;
  • to facilitate the realization of equal opportunities, protection of right and full participation of persons with disability

The Persons With Disabilities (PWD) Act, 1995
This is an act which provide for the Education, Employment, Affirmative Action, Non- Discrimination, Research And Manpower Development, Recognition of Institutions for Persons with Disabilities

The Rehabilitation Council of India Act, 1992
This is an Act to provide for the constitution of Rehabilitation Council of India for regulating the training of rehabilitation professionals and the maintenance of a Central Rehabilitation Register and for Matters connected therewith or incidental thereto.
The Mental Health Act, 1987

The Mental Health Act, 1987 is in force in all states and union territories. The mental health authorities consist of the central authority and the state authority of mental health services, whose main aim is to look after the Establishment and maintenance of psychiatric hospitals and psychiatric nursing homes and granting of license to such institutes. On the whole this act furnishes the provisions for mentally challenged people.
